Florida's statute of limitations for car accidents is laid out in Florida Statutes section 95.11(3)(a), which states that individuals who were injured in a car accident have up to 4 years after the date of their accident to file a lawsuit (the same time limit applies for filing a lawsuit for damage to your vehicle).

However, if you are filing a wrongful death lawsuit for someone who was killed in the car accident, you must file your lawsuit within 2 years of the individual's death, if different from the date of the accident (Florida Statutes section 95.11(4)(d).
